It certifies that the holder is competent to be legally appointed as Mine Manager — the person ultimately responsible for all operations, health, safety and legal compliance on a South African mine.

WHAT IS A MINE MANAGER?
The Mine Manager is the person legally appointed in writing by the employer to manage and control a mine or a section of a mine. Under the MHSA this is the most legally exposed and most professionally demanding position in South African mining. The Mine Manager’s legal responsibilities include:
WHO MUST HOLD A COMPETENT A?
Every mine operating in South Africa must have a legally appointed Mine Manager. That person must hold a valid Competent A Certificate of Competency applicable to the mining method and commodity. This is a non-negotiable legal requirement under the MHSA. There are no exceptions.
Legal Requirements for the Competent A Under the Mine Health and Safety Act
The Mine Health and Safety Act 29 of 1996 imposes the highest legal obligations in South African mining on the Mine Manager. These obligations — and the penalties for non-compliance — make the Competent A the most legally significant qualification in the mining industry.
SECTION 3 OF THE MHSA — THE MINE MANAGER'S DUTIES

SECTION 86 OF THE MHSA — CRIMINAL LIABILITY
Under Section 86 of the MHSA, any person who fails to comply with a provision of the Act is guilty of an offence and liable on conviction to a fine or imprisonment. As the legally appointed mine manager, the Competent A holder bears direct personal criminal liability for contraventions that occur on the mine under their watch.
